Administration, accounting, and auditing are performed by a panel of independent, Australian-based tax agents and auditors.
2. Intellectual Property
All content on My SMSF Property, including e-books, calculators, courses, dashboards, application forms, text, graphics, logos, icons, images, and software, is owned by My SMSF Pty Ltd (Trademark No. 1865433) and protected by Australian copyright and trademark laws.
3. SMSF Administration Service
Annual SMSF administration services require appointing My SMSF and its undersigned as administrator, referring administration work to independent service providers, and appointment on the ATO portal for SMSFAR lodgements.
Service Packages (effective from 1 July 2025)
- Bronze Care: $1,190 (asset values under $1 million)
- Silver Care: $1,550 ($1,000,001 and above, or SMSFs using cold wallets)
- Gold Care: $2,550 ($3 million and higher)
New Fund Setup
- Setup Fee: $990
- Minimum Administration Period:
- Silver & Gold: 1 year
- Bronze: 2 years
- Early Termination Fee if you do not complete your first year return: $550
Transfer SMSF
- Transfer Fee: $220
- Annual administration fee based on selected package.
All funds are subject to these Terms and Conditions, the Privacy Policy, and the Fee Schedule.
Annual Administration Services
Our standard tax return completion timeframe is 8 to 12 weeks for Bronze Care clients, and 3 to 10 weeks for Silver and Gold Care clients, commencing from the date all required documentation has been received. Audit completion generally ranges from 2 to 5 weeks and depends on the complexity and type of investments held within the fund and the timely delivery of supporting documents requested.
My SMSF is not liable for delays, ATO penalties, or interest charges resulting from late lodgment due to incomplete or missing information, delayed responses from clients, or delays in providing required documents. Any resubmitted transaction data and asset valuations that require rework will be charged an additional $155 per instance.
Security
My SMSF uses cloud storage based in Asia, employs two-factor authentication, and blocks offshore access to sensitive information.
4. Investments
- No commissions are received from third-party providers.
- Freedom of choice in selecting financial providers.
- SMSF cash account setup is not included unless requested for Silver and Gold Care clients.
5. General Advice & Client Responsibilities
- Clients must promptly provide requested documentation.
- Delays caused by client non-responsiveness are the client’s responsibility.
- Communication may occur via email, text, and chat, with phone support for Silver & Gold Care clients.
- Client contact details must remain current.
- Average completion timeframe is 1 to 6 months, subject to timely replies and the provision of supporting documents.
- Consultation fees are $110 per half-hour.
- Trustee Education Course completion is required within 4 to 10 weeks of setup.
6. Termination of Administration Services
- Cancellation within the first year incurs a $550 fee.
- Document forwarding to a new provider attracts a $220 fee.
- Subsequent document requests after initial transfer out attract a $330 fee per request.
Erroneous Personal Contributions Paid to the My SMSF Trust Account
Where a personal contribution is mistakenly deposited into the My SMSF trust account rather than the member’s own SMSF bank account, this constitutes a compliance breach of the sole purpose test and we reserve the right to report this to the ATO.
My SMSF will notify the ATO of the error and arrange for the refund of the amount to the original sender when we are contacted by email, with details of the fund and the bank account that the transaction was sent from.
To manage the administration and reporting process, a fee of $110 including GST will be charged to existing clients. For individuals who are not clients of My SMSF, a $220 including GST processing and compliance fee will apply. Members are strongly advised to ensure all contributions are made only to their SMSF’s designated bank account to preserve compliance and avoid delays or penalties.
7. Super Rollovers & ESA Addresses
- Rollovers occur via MyGov or incumbent super fund providers.
- ESA address for rollovers: BGLSF360.
- My SMSF provides a contribution summary for Silver and Gold Care clients once annually. Rollovers are processed via our ESA provider.
8. Crypto Wallets Policy
All SMSF-held cryptocurrency stored in cold wallets must be managed under our Silver Care service due to increased audit and tax scrutiny by regulators.
Clients are required to provide 30 June year-end valuations in AUD, along with a wallet screenshot displaying balances, and TXIDs for each coin held, to meet annual tax and audit compliance obligations. Failure to supply complete and verifiable crypto records may result in additional compliance charges or delays in lodgment.
9. Non-Commercial Use & Dashboard Access
- Dashboard access is strictly for personal use.
- No commercial exploitation is allowed.
- Temporary outages may occur and alternative email communication is advised.
10. Communication
- All communication is subject to legal privilege.
- Fraudulent competitor reviews may be subject to prosecution and ATO reporting.
11. Overpayments & Refund Policy
- Refund requests must be made within 6 months.
- A processing fee of $110 per hour is deducted from refunds.
- Late requests may be attributed to future services.
- Negligent payments may be reported to the ATO.
12. Outstanding Fees & Debt Recovery
- Interest: CPI (3.6%) plus 10% daily compounding.
- Debt collection actions initiated after 90 days incur a 22% fee.
- Clients are liable for recovery and legal costs.
13. Currency
- All references are in Australian Dollars (AUD).
14. User Indemnity
- Users indemnify My SMSF from liabilities arising from misuse or unauthorized alterations of content.
- Anti-competitive behaviors may be reported to relevant authorities, including TPB, CPA, CA, NTAA, Tax Institute, and ACCC.
15. Third Parties
Our website and services may include links to third-party websites, including cryptocurrency exchanges, lenders, and financial service providers. These third parties are independent from My SMSF and are solely responsible for the operation of their websites and services. We do not endorse, control, or assume responsibility for their content, terms, or any transactions you undertake with them.
While we provide these links for informational purposes, it is your responsibility to perform due diligence before engaging with any third-party provider. For a list of the exchanges and lenders we currently reference, please visit our recommended providers page and refer to our Privacy Policy to understand our listing methodology and obligations of listed sites and parties.
- We do not accept calls or requests to be added to our lists.
- We employ a suitability process that tends to suit our clients.
- Ethical letters requested by third-party firms must be directed via email.
16. External Links Disclaimer
- Links are provided for convenience and no endorsement is implied.
- My SMSF is not responsible for external content.
- My SMSF operates with the sole direction and oversight of its appointed director. Any external parties, including minority shareholders, who attempt to interfere with or divert client relationships or services without proper authority may be subject to legal action. We reserve the right to restrict access or engagement with our services where such interference is suspected or substantiated.
17. Documents & Audit Services
- Documents may be sent electronically via PandaDoc or email.
- The client is responsible for timely review and signing.
- Audit duration is generally 3 to 5 weeks, subject to regulatory requirements.
- Audit breach fees range from $330 to $2,200 depending on breach severity.
18. SMSF Setup Service (valued at $1,550)
- Free Trust Deed for 2 to 6 members
- ABN and TFN setup
- SMSF cash account setup for Silver and Gold Care clients upon request
- Electronic rollovers via MyGov (client to set up)
- ESA setup: BGLSF360
- ATO and ASIC correspondence for Silver and Gold Care clients
Setup Conditions
- Minimum $150,000 combined super required.
- Bronze clients must maintain administration for 24 months.
- Early termination incurs a $550 setup fee.
19. Partner & Marketing Collaboration Conditions
My SMSF may engage in promotional collaborations, co-branded content, or marketing partnerships with third-party service providers. All partners must comply with the following conditions to qualify for listing, promotion, or joint marketing activities.
1. Eligibility and Partner Standards
- Operate lawfully within Australia and comply with all ASIC, ATO, AUSTRAC, and relevant regulatory obligations.
- Provide transparent, accurate, and evidence-based information about their products and services.
- Not engage in misleading, deceptive, or unlicensed financial product promotion.
My SMSF reserves the right to approve or decline any partner at its sole discretion.
2. Joint Content & Link-Sharing Requirements
- All content must be factual, non-promotional, and approved by My SMSF prior to publication.
- Reciprocal links must be placed on both parties’ websites in a natural, non-spam manner.
- Both parties must clearly disclose the collaborative nature of the content.
- Partners must not engage in SEO manipulation, link-farming, or deceptive linking practices.
3. Reciprocal Marketing Obligations
- Promote My SMSF services equally to their own clients or subscriber base.
- Provide exposure equivalent to any exposure received from My SMSF.
- Ensure opt-in and consent processes comply with Australian privacy laws.
4. Joint Webinars, Presentations & Prospect Lists
- The prospect list must be jointly collated by both parties.
- Registrants may opt in to communications from either or both organisations.
- No partner may use registrant data without explicit consent.
- Educational integrity must be maintained at all times.
5. Criteria for SMSF Crypto Exchange Listings
- Be established, reputable exchanges with strong market standing.
- Provide transparent fees and easy withdrawal options to self-custody wallets.
- Meet SMSF compliance requirements, including transaction history and audit-ready reporting.
- Disclose KYC, ID verification, and withdrawal procedures.
- Publish or make available Proof of Reserves or equivalent solvency transparency.
- Disclose wallet custody arrangements, insurance coverage, and security practices.
6. Removal, Suspension & Review
- My SMSF may remove or suspend any partner or listing if security breaches, regulatory actions, or material risks arise.
- Removal or suspension may also occur if withdrawal delays, client complaints, or transparency issues occur.
- Removal or suspension may also occur if Proof of Reserves or security standards are withdrawn or not maintained.
- Removal or suspension may also occur if the partner fails to meet ongoing ethical or compliance obligations.
My SMSF retains full discretion over partnerships, listings, and promotional collaborations.
20. Acceptance of Terms & Trustee Responsibility
- Corporate Trustee: $990
- Individual Trustee: $220
By applying online, trustees acknowledge their SMSF responsibilities under SIS Act section 17A and agree to all associated setup charges, including ATO and ASIC fees.
